I would suggest writing both -- but I highly doubt McGanty will pay any attention. H&F might... especially if they start to see IB isn't doing as well as it could be and why
Start telling H&F that McGanty did not do a proper business case analysis and that they will likely not get a return on their investment (ROI), let's see how uncomfortable that would make them.... and I'm sure a few people at Internet Brands management will start squirming in their seats.

Well from Internet Brands i really do not expect anything at all. H&F well there big and i think vBulletin is to small for them to even be concerned if it makes profit. What the best is remove vBulletin under the wing of Internet Brands and give it a capital injection so it has funds for two years after that it needs to pay for its own upkeep.

I am not a USA lawyer but if the law is similar to Australia they could be charged with deceptive trade practises, False advertising, and Misrepresentation. ETC. This does not take into account Libel and defamation by an employee and a host of other charges.
